Official General Contest, Promotion or Giveaway Rules & Regulations General Rules
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.
Eligibility: Any and all contests/promotions/giveaways run by United Motorsports are open only to those 18 years or older in the continental United States. Current or former employees, family members, agents, successors, or assignees of United Motorsports or any promotional agency involved with this promotion shall be INELIGIBLE to participate.
Agreement to Rules: By participating in any contests/promotions/giveaways run by United Motorsports, the Contestant (“You”) agrees to be fully unconditionally bound by these General Rules and such other special rules as may be specific to the contest/promotion/giveaway in question (“Special Rules”). Special Rules may include, but are not limited to, the following: promotion contestants may not be permitted any practice, warm-up, or qualifying attempts; promotion contestants may be required to enter their name, signature, daytime phone number,and/or email address in a contestant sign-in binder, in addition to completing a brief survey; promotion contestants may be videotaped during their participation in the event. You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of United Motorsports as final and binding as it relates to the content of the contests/promotions/giveaways.
Contest/Promotion/Giveaway Period: Entries for any contests/promotions/giveaways run by United Motorsports will be accepted online starting and ending as described on the social media post announcing the contest. All online entries must be received by the deadline on the social media post.
How to Enter: All contests/promotions/giveaways run by United Motorsports must be entered by following the rules as listed in the giveaway post on social media or on www.unitedmotorsportsgiveaway.com. Typically entry requires ‘liking’, ‘commenting’ or other action on the specific social media post. Certain events may require contestants to enter their name, signature, daytime phone number,and/or email address in a contestant sign-in binder, in addition to completing a brief survey. We do not require you to ‘share’ or ‘tag a friend’ to enter a giveaway. The entry must fulfill all requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of United Motorsports. You may enter only once. You must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If You use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of United Motorsports.
Prizes: The Winner/Winners of a contests/promotions/giveaway will receive the giveaway prize as described in the social media post or on www.unitedmotorsportsgiveaway.com. Value of will be listed in the social media post or on www.unitedmotorsportsgiveaway.com. The actual appraised value may differ at the time of prize award. The specifics of the prize shall be solely determined by United Motorsports. No cash or other prize substitution shall be permitted except at United Motorsports’s discretion. The prize is nontransferable. Any and all prizes and related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for United Motorsports to use Winner’s name, “likeness”, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
Odds: The odds of winning depend on the type of event and will be listed in the social media post if discernible. For example, the odds of winning a raffle-type event will depend on the total number of eligible entries received. For events such as hole-in-one contests, the odds of winning will depend on the skill and/or luck of the contestant.
Winner Selection and Notification: Winner will be selected randomly under the supervision of United Motorsports. Winners will be notified by a comment on the specific social media post or with a direct/personal message on the social media platform or by phone call within 3 days following the selection of Winner. United Motorsports shall have no liability for Winner’s failure to receive notices due to spam, junk email or other security settings or for Winner’s provision of incorrect or otherwise nonfunctioning contact information. If Winner cannot be contacted and fails to claim the prize within 30 days from the time award notification was sent or fails to timely return a completed and executed declaration and release as required the prize may be forfeited and an alternate Winner selected. Receipt by Winner of the prize offered in any contests/promotions/giveaway run by United Motorsports is conditioned upon compliance with any and all federal, state, and local laws and regulations.
ANY VIOLATION OF THE GENERAL OR SPECIAL RULES BY WINNER (at United Motorsports sole discretion) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF ANY CONTEST/PROMOTION/GIVEAWAY, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
Rights Granted by You: By entering a contest/promotion/giveaway run by United Motorsports (e.g., photo, video, text, etc.), You understand and agree that United Motorsports, anyone acting on behalf of United Motorsports, and United Motorsports’s licensees, successors, and assigns shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the contest, promotion or giveaway, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes. without any further compensation, notice, review, or consent.
Terms & Conditions: United Motorsports reserves the right, in its sole discretion, to cancel, terminate, modify or suspend any contests/promotions/giveaway should virus, bug, non-authorized human intervention, fraud, or other cause beyond United Motorsports’s control corrupt or affect the administration, security, fairness, or proper conduct of the contests/promotions/giveaway. In such a case, United Motorsports may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by United Motorsports. United Motorsports reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry. United Motorsports has the right, in its sole discretion, to maintain the integrity of a contest/promotion/giveaway, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses, multiple entries from the same computer in excess of that allowed by contest/promotion/giveaway rules, or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the contest/promotion/giveaway may be a violation of criminal and civil laws. Should such an attempt be made, United Motorsports reserves the right to seek damages to the fullest extent permitted by law.
Limitation of Liability: By entering, You agree to release and hold harmless United Motorsports and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from:(i) such entrant’s participation in a contest/promotion/giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service (iv) unauthorized human intervention in any part of the entry process or the contest/promotion/giveaway (v) electronic or human error in the administration of the Promotion or the processing of entries.
Disputes: ALL CONTESTS/PROMOTIONS/GIVEAWAYS IS ARE GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF KENTUCKY WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in a contest/promotion/giveaway, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with any giveaway or contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Lexington, Kentucky having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering any contest/promotion/giveaway). Participant further waives all rights to have damages multiplied or increased.
Privacy Policy: Information submitted with an entry is subject to the Privacy Policy stated on the United Motorsports website.
Sponsor: The sole sponsor of all contest/promotion/giveaway is United Motorsports. All contests/promotions/giveaways are in no way sponsored, endorsed, or administered by, or associated with Facebook, Instagram or any other social media platforms. You understand that you are not interacting with Facebook, Instagram or another social platform. By participating in any contest, giveaway or promotion run by United Motorsports you release Facebook, Instagram or another social platform from any claims.
Contest Rules & Regulations Changes: Although most changes are likely to be minor, United Motorsports may change its Contest Rules & Regulations from time to time, and at United Motorsports’s sole discretion. United Motorsports encourages visitors to frequently check this page for any changes to its Contest Rules & Regulations. Your continued entry in any contest, promotion or giveaway after any change in these Contest Rules & Regulations will constitute your acceptance of such change.
